Medifor Veneta S.r.l. with registered office in Via Manin 116/13 31015 Conegliano, Italy and administrative headquarters in Via Padania 11 / C 31020 San Vendemiano, Italy (hereinafter referred to as the "Data Controller") in their capacity as data controller of your personal information, informs you that, pursuant to art. 13 of Legislative Decree 196/2003 (hereinafter "Privacy Code) and of the art. 13 EU Regulation n. 2016/679 (hereinafter "GDPR") your data is collected and processed in the manner and for the purposes set out below.
1. Object of the processing
The Data Controller processes personal data, both identifying and non-sensitive (hereinafter referred to as "data") such as name, surname, company name, address, telephone number, e-mail address, bank and payment references, etc.
2. Purpose of the processing and legal basis
Your personal data is collected and processed:a. Without your express consent (art. 24 Privacy Code and art. 6 GDPR) for the following services purposes:- Conclude contracts for the Data Controller's goods and / or services
- Fulfill the pre-contractual, contractual and fiscal obligations deriving from existing relationships with you
- Fulfill the obligations provided for by the law, by a regulation, by the community legislation or by an order of the Authority
- Exercise the rights of the Data Controller, for example the right to defense in court;
b. Only with your specific and distinct consent (art. 23 and 130 Privacy Code and art. 7 GDPR), for the following commercial or marketing purposes:
Send you via email, post and / or text message and / or telephone contacts, information, commercial communications and / or advertising material about products or services offered by the Data Controller or their business partners;
The provision of data for the purposes indicated in sub a. is necessary to carry out the supply of goods and services required, as required by legal and contractual obligations.
The provision of data for the purposes indicated in sub b. is optional and you can revoke the consent given for the treatments indicated at any time by sending an email to the address info@mediforveneta.com
We underline that if you are already our customers, we will be able to send you commercial communications relating to services and products of the Data Controller similar to those that you have already received, unless you disagree (art. 130 co. 4 Privacy Code)
3. Legitimate interests of the Data Controller
The legitimate interests of the Data Controller consist in respecting and honoring the contractual obligations signed by the parties. Pursuant to art. 6 GDPR the lawfulness of the processing is based on the consensus expressly expressed by the interested party.
4. Processing methods
The processing of your personal data is carried out by means of the operations indicated in the art. 4 Privacy Code and art. 4 n. 2) GDPR, namely: collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction of data. Your personal data is processed both on paper and electronic and / or automated mean. The processing is carried out by appointees and collaborators in the context of their respective functions and in accordance with the instructions received, always and only for the achievement of specific purposes, scrupulously respecting the principles of confidentiality and security required by the applicable regulations.
5. Access to data
Your data may be made accessible for the purposes referred to in point 2:- To the employees and collaborators of the Data Controller in their capacity as appointees and / or internal processors and / or system administrators
- To third party companies or other subjects (for example, credit institutions, professional firms, consultants, insurance companies, etc.) who carry out outsourced activities on behalf of the Data Controller, in their capacity as external processors, whose list is available at our headquarters.
6. Data communication
Without the need for express consent (Article 24 of the Privacy Code and Article 6 of the GDPR), the Data Controller may communicate your data for the purposes referred to in point 2.a to Supervisory Institutions, Judicial Authorities and all other subjects to whom communication is mandatory by law for the fulfillment of the aforementioned purposes. Your data information will not be disseminated.
7. Data transfer
Your data is not object of transfer outside the European Union.
8. Data retention
All personal data provided will be treated in accordance with the principles of lawfulness, correctness, relevance and proportionality, only with the methods, including computerized and online, strictly necessary to pursue the purposes described above.
The data will be kept for 5 or 10 years only for documents of a civil, accounting and fiscal nature as foreseen by the laws in force, any other data will be kept for 5 years from the termination of the goods supply / relationship unless the consent is revoked or cancellation requested by you. Personal data for which conservation is not necessary in relation to the purposes indicated will be deleted or transformed into an anonymous form.
9. Rights of the interested party
As an interested party, you have the rights set forth in art. 7 Privacy Code and art. 15 GDPR, namely the rights of:
- Obtain confirmation of the existence or not of personal data concerning you, even if not yet recorded, and their communication in an intelligible form;
- Obtain the indication: a) of the origin of the personal data; b) of the purposes and methods of processing; c) of the logic applied in the case of processing carried out with the aid of electronic instruments; d) of the identification data concerning the Data Controller, data processors and the designated representative; e) of the subjects or categories of subjects to whom the personal data may be communicated or who can learn about them in their quality as appointed representative in the State, of managers or appointees;
- Obtain: a) updating, rectification or, when of interest, integration of data; b) the deletion, transformation into anonymous form or blocking of data processed in violation of the law, including data which do not need to be kept for the purposes for which the data was collected or subsequently processed; c) the attestation that the operations referred to in letters a) and b) have been brought to the attention, also with regard to their content, of those to whom the data have been communicated or disseminated, except in the event that such fulfillment proves to be impossible or involves a manifestly disproportionate use of resources with respect to the protected right;
- To object, in whole or in part: a) for legitimate reasons to the processing of personal data concerning you, even if pertinent to the purpose of collection; b) to the processing of personal data concerning you for the purpose of sending advertising materials or direct sales or for carrying out market research or commercial communication, through the use of automated call systems without the intervention of an operator by e-mail and / or through traditional marketing methods by phone and / or mail. Please note that the interested party's right of objection, set out in the previous point b), for direct marketing purposes by automated means, extends to the traditional ones and that the possibility for the interested party to exercise the right of opposition remains valid even if only partially. Therefore, the interested party can decide to receive only communications using traditional methods or only automated communications or none of the two types of communication.
Where applicable, you also have the rights set forth in Articles 16-21 GDPR (Right of rectification, right to be forgotten, right to limitation of treatment, right to data portability, right to object), as well as the right to complain to the Guarantor Authority.
